1. Overview
This website is operated by Southside Custom Hats. Throughout these Terms, “Southside Custom Hats,” “we,” “us,” and “our” refer to Southside Custom Hats.
By visiting southsidecustomhats.com, purchasing a product, scheduling a consultation, or otherwise using our website and services, you agree to these Terms of Service. If you do not agree, please do not use the website or place an order.
Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.
2. Eligibility and Appropriate Use
You must be legally able to enter into a binding agreement to place an order. You may not use our website or products for an unlawful purpose, attempt to interfere with the website’s operation, introduce malicious code, or violate the rights of Southside Custom Hats or another person.
3. Products and Services
We offer handcrafted custom hats, unique one-off hats, consultations, and related products or services.
We make reasonable efforts to display product colors, materials, measurements, and other details accurately. However, screen settings, lighting, natural materials, and the handmade process can cause reasonable differences between photographs, samples, and finished products.
We may modify or discontinue products, services, prices, or website content at any time. Availability is not guaranteed until an order has been accepted.
4. Custom-Hat Orders
Every custom hat is designed and made specifically for one client. A consultation, conversation, or estimate does not by itself create an accepted order. An order is accepted after we confirm its details and receive any required payment or deposit.
Before production, the client is responsible for reviewing and approving the agreed measurements, materials, colors, design elements, estimated price, and other order details.
Reasonable variations are an expected part of work made by hand. Minor differences in color, texture, grain, shape, stitching, or placement that do not materially change the approved design are not defects.
Requests to change an order after approval may affect its price and completion date. Some changes might not be possible after materials have been purchased or production has begun.
5. Measurements and Fit
Accurate measurements are essential to a properly fitting hat. Clients must follow our measuring instructions carefully and provide complete and accurate information.
When we perform or confirm a fitting, we will make the hat according to the measurements and fit decisions recorded during that process. Fit preferences remain personal, and minor adjustments may sometimes be appropriate after the hat has been worn.
We are not responsible for fit problems caused by inaccurate customer-supplied measurements, changes in the client’s measurements, failure to follow measuring instructions, or alterations performed by someone else. If there is a fit concern, please contact us so we can review the situation and determine whether an adjustment is available.
6. Consultations and Scheduling
Consultations are used to discuss fit, style, materials, intended use, pricing, and design options. Any consultation fee, appointment deposit, cancellation rule, or rescheduling requirement will be disclosed when the appointment is booked.
A consultation does not guarantee that every requested design, material, deadline, or price will be available. We reserve the right to decline a project that we cannot complete safely, lawfully, or to our quality standards.
7. Customer-Supplied Designs and Materials
If you provide a logo, photograph, artwork, name, phrase, trademark, or other material for a custom order, you confirm that you own it or have permission to use it and authorize us to reproduce it for your order.
You may not ask us to reproduce material that infringes another person’s rights or is unlawful, threatening, hateful, or otherwise inappropriate. We may refuse or cancel a design request for these reasons.
The client is responsible for claims resulting from material the client supplied or specifically instructed us to reproduce.
8. One-Off Hats
One-off hats are individually made pieces and may not be reproducible. Variations in size, shape, materials, or decoration will be described on the relevant product page.
Placing an item in a shopping cart does not reserve it. If a one-off item becomes unavailable because of an inventory error or simultaneous purchase, we may cancel the affected order and refund the amount paid.
9. Pricing, Payment, and Taxes
Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, consultation fees, deposits, and approved customizations may be added during checkout or described in the custom-order summary.
You agree to provide current, complete, and accurate billing and payment information. We may correct pricing errors, reject an order, or cancel an order before fulfillment. If we cancel an order after payment for a reason unrelated to a customer’s breach of these Terms, we will refund the canceled amount.
10. Production and Delivery
Custom-hat production dates are estimates because material availability and the handcrafted process can vary. We will communicate any material delay when reasonably possible.
Shipping estimates begin after an order is completed and handed to the carrier. Carrier delivery dates are estimates and are not guaranteed by Southside Custom Hats.
Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address, refused shipment, or unclaimed package may be charged to the customer where permitted by law.
Please inspect your order promptly after delivery and contact us if it arrives damaged, appears defective, or differs materially from what was ordered.
11. Returns and Our Make-It-Right Commitment
Returns, exchanges, cancellations, and refunds are governed by our Refund Policy, which is incorporated into these Terms.
Because custom hats are made specifically for one individual, custom-hat purchases are final sale except where otherwise required by law. Nevertheless, we stand behind our craftsmanship. If a custom hat arrives damaged, has a workmanship defect, does not fit according to measurements we confirmed, or differs materially from the approved design, contact southsidecustomhats@gmail.com within seven calendar days of delivery.
We will review the concern in good faith and, when appropriate, offer an adjustment, repair, replacement, or another reasonable remedy. Please contact us before returning any item.
12. Care and Use
Hats may be affected by moisture, heat, improper storage, cleaning products, excessive handling, or normal wear. Customers are responsible for following any care instructions supplied with the product.
Damage caused by misuse, accidents, improper care or storage, ordinary wear, or work performed by someone other than Southside Custom Hats is not considered a workmanship defect.
13. Intellectual Property
The website and its original text, photographs, graphics, logos, hat designs, and other content belong to Southside Custom Hats or are used with permission. They may not be copied, reproduced, sold, modified, or used commercially without prior written permission.
Purchasing a hat does not transfer ownership of Southside Custom Hats’ underlying designs, photographs, branding, or other intellectual property.
14. Reviews and Submitted Content
If you submit a review, photograph, comment, or other content, you confirm that it is truthful, lawful, and does not violate another person’s rights.
You grant us permission to display submitted reviews and related content in connection with our store and marketing. We will request separate permission before using identifiable client photographs from a private consultation or custom fitting for promotional purposes.
15. Third-Party Services and Links
Our website may use Shopify and other third-party services for hosting, payment processing, scheduling, shipping, analytics, or other functions. Those services may be subject to their own terms and privacy practices.
Links to third-party websites are provided for convenience. We are not responsible for third-party websites, products, services, content, or practices.
The collection and use of personal information through the store are governed by our Privacy Policy.
16. Disclaimer of Warranties
We will provide our products and services with reasonable care and in accordance with the descriptions and commitments we make to you.
Except for warranties that cannot legally be excluded, the website is provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or free from errors.
Nothing in these Terms excludes consumer protections or warranties that cannot be waived under applicable law.
17. Limitation of Liability
To the fullest extent permitted by law, Southside Custom Hats will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services.
Our total liability for a claim relating to a product or service will not exceed the amount paid for the product or service giving rise to that claim, except where a different remedy or limitation is required by law.
These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by our negligence, or any other liability that cannot legally be limited.
18. Events Outside Our Control
We are not responsible for a delay or failure caused by circumstances reasonably outside our control, including severe weather, natural disasters, carrier interruptions, material shortages, labor disruptions, government actions, power failures, or widespread technology outages. We will make reasonable efforts to communicate with affected customers and complete or resolve affected orders.
19. Governing Law
These Terms and transactions with Southside Custom Hats are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where the mandatory consumer laws of another jurisdiction apply.
Before beginning formal legal proceedings, you and Southside Custom Hats agree to make a good-faith effort to resolve the dispute directly.
20. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our decision not to enforce a provision on one occasion does not waive our right to enforce it later.
21. Changes to These Terms
We may update these Terms by posting a revised version on this website. Changes apply from the stated effective date and do not retroactively change an already accepted order unless both parties agree or the law requires otherwise.
